Private Nutritional Therapy Services

These Terms & Conditions apply to private individual Nutritional Therapy services provided by Nutrivival.

They should be read together with the relevant Nutritional Therapy programme or package information, booking confirmation and Nutrivival Privacy Policy.

By booking and proceeding with Nutritional Therapy, you agree to these Terms & Conditions.

1. About Nutritional Therapy

Nutritional Therapy uses evidence-informed nutrition and lifestyle approaches to support individuals to improve their health and wellbeing.

The degree of benefit obtained from Nutritional Therapy will vary between individuals. Nutritional Therapy cannot guarantee a particular health outcome.

Recommendations will be tailored to the individual’s circumstances, health concerns, goals, lifestyle and information provided during the consultation process.

Nutritional Therapy is complementary to, and does not replace, appropriate medical care or treatment.

Nutrivival does not diagnose medical conditions or provide medical treatment. Where appropriate, your Nutritional Therapist may recommend that you consult your GP, registered dietitian, pharmacist or another suitably qualified healthcare professional.

2. Your Nutritional Therapist

Anna Earl, trading as Nutrivival, is a qualified nutrition professional, a member of the British Association for Nutrition and Lifestyle Medicine (BANT) and the Complementary and Natural Healthcare Council (CNHC), where applicable to her clinical practice.

Anna maintains appropriate continuing professional development and works within the scope of her qualifications, professional competence and relevant professional standards.

Your Nutritional Therapist will provide nutritional and lifestyle recommendations based on the information you provide and the scope of Nutritional Therapy.

Your Nutritional Therapist is not qualified to diagnose medical conditions and may recommend that you seek medical advice if there are concerns about your health or if your circumstances fall outside the scope of Nutritional Therapy.

3. Your Agreement with Nutrivival

Your agreement with Nutrivival comprises:

  • your completed Nutritional Therapy Health Questionnaire;
  • your completed and signed Client Consent documentation;
  • any relevant Food Diary or other information requested before your consultation;
  • these Terms & Conditions; and
  • the Nutrivival Privacy Policy.

These documents, together with the details of the Nutritional Therapy programme or package agreed with you, form the basis of your agreement with Nutrivival.

You are responsible for providing accurate and complete information relevant to your health and circumstances.

4. Nutritional Therapy Services

Your Nutritional Therapy programme will normally begin with an initial consultation, either face-to-face or virtually, as agreed at the time of booking.

Where consultations are provided virtually, an appropriate secure online platform will be used and a link will be provided before the appointment.

Follow-up consultations may be conducted face-to-face or virtually, depending on the programme, your preference and practical arrangements.

Unless otherwise agreed:

  • Initial consultations are approximately 75 minutes;
  • Follow-up consultations are approximately 45 minutes.
  • One-off hourly sessions may be booked outside of set programmes.

The exact services included in your programme or package will be confirmed at the time of booking.

Nutrivival may update or change the packages offered from time to time. Any changes will not affect packages that have already been purchased.

5. Discovery Call and Booking

Where appropriate, an initial conversation or Discovery Call may be offered to establish whether Nutritional Therapy is suitable for you and which programme may be most appropriate.

A booking will be confirmed by email and will include the relevant appointment details, including the consultation location where applicable.

Your Nutritional Therapy programme will not normally commence until the required pre-consultation documentation has been completed and payment has been received.

6. Health Information and Medical Care

You must provide your Nutritional Therapist with accurate and relevant information about:

  • medical diagnoses and health conditions;
  • current or recent medical treatment;
  • prescribed medication;
  • herbal medicines;
  • food supplements and nutraceuticals;
  • allergies and intolerances; and
  • any other information that may reasonably affect your Nutritional Therapy programme.

You should inform your GP or other relevant healthcare professional about nutritional or lifestyle strategies you are undertaking where appropriate, particularly where you have a diagnosed medical condition or are taking prescribed medication.

Nutritional Therapy recommendations may need to be adapted where you have a medical condition, are taking medication or are undergoing treatment.

You should contact your Nutritional Therapist promptly if your health circumstances change during your programme.

You should also seek appropriate medical attention where you experience new, persistent or concerning symptoms.

Nutrivival does not accept responsibility for health outcomes resulting from information that was not disclosed to the Nutritional Therapist or from failure to follow appropriate medical advice.

7. Personalised Health Plan

Where a Personalised Health Plan forms part of your programme, it will normally be provided within three working days of your initial or relevant follow-up consultation.

The plan will reflect the information discussed during your consultation and is intended to provide practical recommendations for you to implement.

Nutrivival staff do not normally work at weekends, and delivery times may therefore vary where a consultation takes place immediately before or during a weekend or public holiday.

A Personalised Health Plan is not a substitute for medical diagnosis or treatment.

8. Communication and Support Between Sessions

Where included within your package, you may receive telephone or virtual check-ins between formal consultations. These are intended to provide brief support, review progress and address straightforward questions relating to your agreed health plan.

Minor adjustments to your plan may be agreed during these contacts and will be recorded in your client file where appropriate.

You may also contact your Nutritional Therapist by email with brief questions relating to your programme.

Emails will normally be acknowledged within 48 hours during working days.

Questions requiring substantial additional research, clinical consideration or preparation may need to be addressed during your next scheduled consultation or may incur an additional charge if significant additional work is required.

Social media and text messaging are not secure forms of communication for discussing clinical information and should not be used for this purpose.

Text messages may be used for appointment arrangements and other administrative matters.

9. Confidentiality and Privacy

Information provided during your Nutritional Therapy programme will be treated as confidential and handled in accordance with Nutrivival’s Privacy Policy and applicable data protection legislation.

Information contained within your client record will not normally be shared with third parties without your consent, unless disclosure is required or permitted by law or is necessary to protect your safety or the safety of another person.

Your client record may include health information and other personal information necessary for the provision of Nutritional Therapy.

10. Recording of Consultations

Consultations must not be audio- or video-recorded by either the client or Nutrivival without prior agreement.

This is intended to protect the confidentiality of information discussed during consultations and the integrity of the client record.

If you require an alternative accessibility arrangement, please discuss this with your Nutritional Therapist before your consultation.

11. Supplements and Functional Testing

Where appropriate, your Nutritional Therapist may recommend well-researched food supplements, nutraceuticals or functional testing as part of your Nutritional Therapy programme.

Supplements, nutraceuticals and testing are not included within the standard consultation or package fee unless specifically stated.

Any recommendations will be made within the scope of your Nutritional Therapist’s professional competence and based on the information available at the time.

If you experience an adverse effect after taking a recommended supplement, you should stop taking it and contact your Nutritional Therapist promptly. If symptoms are severe or concerning, seek appropriate urgent medical attention.

You should contact your Nutritional Therapist before continuing a supplement programme beyond the period originally recommended.

Where Nutrivival receives a commission or other financial benefit from the purchase of a recommended product or service, this will be disclosed to you. Any such recommendation will be made on the basis of its suitability and relevance to your circumstances rather than solely on the availability of commission.

12. Payment

Private Nutritional Therapy packages and consultations must normally be paid for in full at the time of booking and before work on your case commences.

If payment has not been received, Nutrivival reserves the right to cancel or postpone the booking.

You should retain a copy of your Client Consent documentation for your records.

13. Cancellation and Changes to Appointments

Nutrivival understands that circumstances can change and will make reasonable efforts to accommodate appointment changes where possible.

A minimum of three working days’ notice is requested for cancellation or rearrangement of an appointment.

If you provide less than three working days’ notice, 50% of the relevant consultation fee may be retained to reflect time already reserved and preparation undertaken.

If you fail to attend an appointment, or cancel on the day of the appointment, 100% of the relevant consultation fee will normally be payable.

Where a missed consultation forms part of a package, the relevant session may be treated as used.

Exceptions may be considered at Nutrivival’s discretion where there are genuinely unforeseen or exceptional circumstances.

Requests to rearrange an appointment should be made by contacting Nutrivival as soon as possible.

14. Cancellation by Nutrivival

If Nutrivival needs to cancel or postpone a consultation because of illness, emergency or unforeseen circumstances, reasonable efforts will be made to provide as much notice as possible.

Nutrivival will normally offer an alternative appointment.

Where an alternative appointment cannot reasonably be provided, a refund may be offered for the affected consultation or for any unused portion of a package, as appropriate.

15. Programme Duration and Expiry

Unless otherwise agreed, Nutritional Therapy packages must be started and completed within 90 days of purchase.

Follow-up consultations forming part of a package should normally be arranged during or at the conclusion of the preceding consultation to ensure that the programme progresses appropriately.

Unused sessions after the applicable expiry period may be forfeited and will not normally be refundable.

Nutrivival may, at its discretion, agree to extend a programme where circumstances make completion within the standard period unreasonable.

Requests for an extension should be made before the package expires.

16. Consumer Cancellation Rights and Refunds

Where you purchase Nutritional Therapy services as a consumer, statutory cancellation rights may apply depending on how and where the contract is made.

Where applicable, you may have a 14-day cancellation period for certain distance or off-premises contracts.

If you ask Nutrivival to begin providing services during this cancellation period, you may be required to pay for services provided up to the point at which you cancel.

Where a service has been fully provided at your request during the applicable cancellation period, the statutory right to cancel may no longer apply.

Different rules may apply to digital content supplied to you where you have expressly agreed that provision should begin during the cancellation period.

Nothing in these Terms & Conditions is intended to limit any statutory rights that you have as a consumer.

17. Refunds

Nutrivival aims to provide a professional, high-quality service and will work with you to resolve any concerns about your programme.

Where a refund is appropriate, it will be considered according to the circumstances of the booking and any applicable statutory rights.

If you are unable to complete a programme because of a significant change in circumstances, including a medical reason, Nutrivival may consider a refund for unused sessions.

Where appropriate, Nutrivival may ask for reasonable evidence to support a request for a refund or extension.

If Nutrivival is unable to complete your programme, reasonable efforts will be made to offer an alternative arrangement where possible.

If an alternative arrangement is not appropriate or cannot reasonably be provided, a refund may be offered for any unused services.

18. Your Responsibilities

You agree to:

  • provide accurate and complete information relevant to your health and circumstances;
  • inform your Nutritional Therapist of significant changes to your health, medication or treatment;
  • follow appropriate medical advice from your GP or other healthcare professionals;
  • ask for clarification if you are unsure about any recommendation;
  • inform your Nutritional Therapist of any adverse effects or concerns relating to recommended supplements;
  • attend appointments at the agreed time; and
  • take responsibility for the decisions you make regarding your diet, lifestyle and health.

Nutritional Therapy recommendations are based on the information available at the time of consultation. Your circumstances and health may change, and recommendations may therefore need to be reviewed.

19. Professional Boundaries

Nutritional Therapy is intended to complement, rather than replace, appropriate medical care.

Nutrivival will work within the scope of Nutritional Therapy and will not provide medical diagnosis or treatment.

Where your needs fall outside the scope of Nutritional Therapy or Nutrivival’s professional competence, you may be advised to seek support from another appropriately qualified professional.

Your Nutritional Therapist may recommend that you contact your GP or another healthcare professional where this is considered appropriate.

20. Intellectual Property

All Nutrivival materials provided to you as part of your programme remain the intellectual property of Nutrivival unless otherwise agreed in writing.

This includes, but is not limited to:

  • Personalised Health Plans;
  • worksheets;
  • educational resources;
  • written materials;
  • recipes;
  • programmes;
  • frameworks;
  • presentations; and
  • other materials created by Nutrivival.

Materials are provided for your personal use and must not be commercially reproduced, sold, distributed or used to provide nutritional advice or services to others without prior written permission.

21. Complaints

Nutrivival aims to provide a professional, supportive and high-quality service.

If you have a concern or complaint, please raise it with Anna Earl as soon as reasonably practicable so that it can be considered and, where possible, resolved.

22. Changes to these Terms & Conditions

Nutrivival may update these Terms & Conditions from time to time.

The version applicable to your programme will normally be the version provided to you at the time of booking.

Any material change affecting an existing programme will be communicated to you where appropriate.

23. Governing Law

These Terms & Conditions and any dispute or claim arising from them shall be governed by the laws of England and Wales.

Nothing in these Terms & Conditions affects any statutory rights you may have as a consumer.

24. Agreement

By booking a Nutritional Therapy consultation or programme and proceeding with the service, you confirm that you have read and understood these Terms & Conditions and agree to them.

Your completed Client Consent documentation, Health Questionnaire, relevant food diary or other pre-consultation information, these Terms & Conditions, the Nutrivival Privacy Policy and the details of the programme purchased together form the basis of your agreement with Nutrivival.
